Copyright


Copyright is the exclusive right to the Creator or the recipient of such right to publish or reproduce the work or give permission for it, in the field of science, art or literature.


The Works that are protected by the Copyright include:

  • Books, pamphlets, layout, published essays, and all other written works
  • Lecture, speech, and other creatures similar to it
  • Props made for the purposes of education and science
  • Song or music with or without text
  • Drama or musical drama, dance, choreography, puppetry and pantomime
  • Fine art: painting, drawing, sculpture, calligraphy, collage, and applied arts
  • Architecture
  • Batik art
  • Photography
  • Cinematography
  • Translation, interpretation, summary, potpourri, databases, and other works resulting from interpretations
  • Computer programs

PATENT


Patent is an exclusive right granted by the State to an Inventor on the results of Invention in the technology field, which for a certain period to implement the invention itself or give consent to others to carry it out. There are 2 (two) types of patents that can be registered, general patent and simple patent.


The requirement for the inventions that can be patented:

  • Novelty. It is anew discovery, not a prior inventions.
  • Inventive Steps. The inventions can not be predicted before.
  • Industrial applicable. It should apply in the industry.

The inventions that can not be patented:

  • Process or production contrary to the laws, religion, public order or morality
  • Methods of examination, care, treatment and / or surgery applied to humans and / or animals
  • Theory and methods in the field of science and mathematics
  • All living beings, except micro-organism
  • The biological processes that are essential for the production of plants or animals, except non-biological or microbiological processes

TRADEMARK


The trademark right is an exclusive right granted by the State to the owner of trademark listed in the General Register for a certain period of time to use their own trademark or grant permission to others to use it.

  • Trademark is a sign in the form of images, names, words, letters, figures, composition of colors, or a combination of these elements, having distinguishing features and used in the trading of goods or services.
  • The trademarks that can be registered is a trademark that is neither too complicated nor too simple, having distinguishing features so as not to confuse consumers.

INDUSTRIAL DESIGN


Industrial Design is a creation of shape, configuration or composition of lines or colors, or a combination thereof in the form of three-dimensional or two-dimensional that gives aesthetic impression and can be used to produce a product, goods, industrial commodity or handicraft.


PVT


Plant variety is a group of plants of a species that is characterized by the shape of the plant, plant growth, leaves, flowers, fruits, seeds, and the genotype expression characteristics or combination of genotypes that can distinguish the type or species of the same by at least one determined nature and if multiplied it is unchanged.


The conditions of variety that can be granted PVP in Indonesia are as follows:

  • New
  • Unique
  • Uniform
  • Stable
  • Given the name
Term of Protection:

  • Period of 20 years for seasonal crops.
  • Period of 25 years for annual crops.

SICDL


Integrated Circuit is a product in the form of finished or semi-finished, in which there are different elements and at least one of which is an active element, which partially or completely intertwined and formed integrally in a semi-conductor material which is intended to produce electronic functions.


While Layout Design is the creation of three-dimensional design of the various elements, at least one of which is an active element, and some or all of the interconnections in an integrated circuit and the three-dimensional layout is meant for the preparation of Integrated Circuits.

The exclusive rights
There are two exclusive rights held by the holders of Integrated Circuit Layout Design, among others:

  • The right to implement its own design, and
  • The right to prohibit other parties without the holder’s consent to make, use, sell, import, export and distribute the products related to design the layout of integrated circuits.

Trade Secret


Trade secret is an information that is not known by the public in the field of technology and / or business, has economic value because it is useful in business activities, and kept secret by its owner.




Trade Secret requirements

The conditions constituting a Trade Secret:

  • Confidential Information: Not a thing which has been known to the general public
  • It has a commercial value
  • Kept secret : The obligation to maintain confidentiality with reasonable action
